WCCHSE Terms of Use

By using this website (the “Website”), you indicate that you have read, fully understand and agree to be legally bound by the Western Canada Collaborative of Health Sciences Educators Society (the “WCCHSE”) terms of use (the “Terms of Use“) and to comply with all applicable laws and regulations as they may change from time to time. IF YOU DO NOT ACCEPT AND AGREE TO BE LEGALLY BOUND BY AND COMPLY WITH THESE TERMS OF USE, YOU ARE NOT PERMITTED TO ACCESS OR USE THE WEBSITE. We suggest you print a copy of the Terms of Use for your records.

AMENDMENTS TO THE TERMS OF USE

We reserve the right, in our sole and absolute discretion, to modify all or a portion of the Terms of Use at any time without further notice and without incurring any liability or obligation. If we do this, we will post the changes and will indicate at the top of this page the date the Terms of Use were last revised. Your continued access to and/or use of the website after any such changes constitutes your acceptance of, and agreement to be legally bound by, these Terms of Use, as revised. It is your sole responsibility to regularly check the website to determine if there have been any changes to the Terms of Use and to review such changes.

You hereby acknowledge and agree that we reserve the right at any time to modify or discontinue the whole, or any part of, the website without notice, and that we will not be responsible or liable, directly or indirectly, to you or any other person or entity for any loss or damage of any kind incurred as a result of any such modifications or discontinuance.

INTELLECTUAL PROPERTY RIGHTS

The Website consists of various information such as texts, icons and buttons that have been provided by WCCHSE, other entities under WCCHSE’s direction (e.g. site designers) or is used under licence. All such content is owned by WCCHSE and/or the applicable third party entity. WCCHSE and the applicable third-party entities hold all right, title, and interest in and to any and all content provided by such parties for the Website, including, without limitation, all such information in text, graphical, video and audio formats, images, icons, designs, trade-marks, brand names and software – the site content. Users and members of the WCCHSE Website and members only portal shall be entitled to copy content contained for their own personal and non-commercial use, but may not republish or reproduce any content in any manner without the prior written consent of WCCHSE.

The trademarks, logos, and service marks displayed on this site are registered and unregistered trademarks of WCCHSE and others, and so your own use of them is prohibited.

WCCHSE SOCIAL MEDIA

Our posts are intended for all persons interested in WCCHSE education issues, trends, practice, and research. The views expressed or implied by WCCHSE volunteers are solely those of the authors and do not necessarily reflect the views of the WCCHSE membership/volunteers. Postings made by the WCCHSE volunteers are meant to inform, provoke discussion, and/or provide an official position.

Images of people used on our site and social media are used with permission or in accordance with applicable law. Reuse of such pictures without the necessary permission may violate the privacy and publication rights of those persons.

MEMBERS REGISTRATION

Users of the Website are required to register as members of WCCHSE in order to post information, rubrics, policies and to view other members’ posts. WCCHSE reserves the right to suspend or terminate access to commenting features by registered users or members. Personally identifiable information that is submitted during registration is governed by WCCHSE’s Privacy Policy.

MEMBERS USERNAME AND PASSWORD

When registering as members, members must choose a username and password. Members should safeguard their login credentials as they are solely responsible for their account. Members shall notify WCCHSE immediately of any unauthorized use of their account. Members are recommended to logout after each session. WCCHSE will not be held responsible for losses or damages due to unauthorized use of a member’s account or failure of the member to logout of their member account.

MEMBERS PORTAL CONTENT – SHARING

By using the members only portal and submitting content, you hereby acknowledge, agree, warrant and represent to WCCHSE that any and all submissions (in any format or media): (a) are original to you/ your organization and that you have obtained all necessary rights in and to the submission and all of its components (if applicable) to submit through the portal; and (b) do not violate any law.

Without limiting the generality of the foregoing, you also hereby acknowledge, agree, warrant and represent to WCCHSE that WCCHSE cannot (nor is WCCHSE required to) guarantee the accuracy, reliability or completeness of any submissions.

Except where otherwise noted, all content posted in the members only portal will be licensed under an attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0). Prior to submitting of any information, the member shall ensure permission to share by the authors of the work, if the work is not their own.  In addition, the member will attach the following image set out below  as well as link to the creative commons site:

Thus members will be free to copy, distribute and transmit content provided it is distributed in its entirety, and proper credit is given to the author, the institution and WCCHSE (as applicable). You may do so in any reasonable manner, but not in any way that suggests WCCHSE or licensor endorses you or your use. You may not use the material for commercial purposes. If you remix, transform, or build upon the material, you must distribute your contributions under the same license as the original. Some of the information on the Website may link to external websites. WCCHSE is not responsible for the accuracy, reliability, currency of information contained on external websites, or damages incurred from visiting external websites. WCCHSE is not responsible for inactive links. These other websites may have their own privacy policies and terms and conditions that are not governed by WCCHSE’s Privacy Policy or the Terms of Use. Any links from the Website to other websites, or references to products, services or publications other than those of WCCHSE, do not imply the endorsement or approval of such websites, products, services or publications by WCCHSE.

INDEMNIFICATION BY USER

By using the Website and/or members only portal, you hereby agree to indemnify, defend and hold harmless WCCHSE , and each of its respective agents, employees, directors, successors, and assigns (collectively, the “Releasees”) from any loss, liability, claim, demand, damage or expense asserted by any entity relating in any way to your use of the Website and/or members only portal, user materials, and/or breach of the Terms of Use, including, without limitation, any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other cause of action.

WCCHSE does not endorse advertisements that appear on the WebsiteWCCHSE is not responsible for the content of external websites.

WARRANTIES, DISCLAIMERS, LIMITATION OF LIABILITY

Except as expressly provided otherwise in a written agreement between you and WCCHSE, all material on the Website is provided “as is” without any other warranties or conditions, express or implied, including but not limited to, warranties of merchantable quality, satisfactory quality, merchantability or fitness for a particular purpose, or those arising by law, statute, usage of trade, or course of dealing.  WCCHSE assumes no responsibility for errors or omissions in the materials or other documents which are referenced by or linked to this Website.

In no event shall the WCCHSE be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever including without limitation, those resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, including tort, arising out of or in connection with the use or performance of this information.

WCCHSE cannot and does not warrant that the Website will be uninterrupted, secure, error free, accurate, complete or current.  Nor does WCCHSE make any warranty as to the results that may be obtained from the use of the Website or as to the accuracy or reliability of any information obtained through the Website.  The Website could include technical or other inaccuracies or typographical errors.  Changes are periodically added to the information, these changes will be incorporated in updates.  WCCHSE may make changes in the Website at any time.

Any material and or date uploaded, downloaded or otherwise obtained through the use of the Website is done at your own discretion and risk.  WCCHSE does not warrant or guarantee that such materials are free of viruses or other destructive code that may damage or infect your computer equipment or other property.  You will be solely responsible for any damages to your computer system or loss of data that results from uploading and/ or downloading such material and /or data.  If you are dissatisfied with any portion of the Website, or with these terms and conditions, your sole and exclusive remedy is to discontinue using the Website.

GOVERNING LAWS

The Terms of Use, your use of the Website and all related matters shall be governed solely by the laws of the Province of British Columbia, Canada and the applicable federal laws of Canada, without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of British Columbia in relation to all disputes arising from or related to this Agreement, your use of the Website and any related matters.

SEVERABILITY

If any provision of the Terms of Use is declared by a court of competent jurisdiction to be invalid, illegal or unenforceable, such provision or part thereof which is necessary to render the provision valid, legal and enforceable, shall be severed from the agreement and the other provisions and the remaining part thereof of that provision shall remain in full force and effect.
